Terms and Conditions

1. General

These Terms and Conditions take precedence, including in cases where the client’s terms and conditions conflict. Amendments require written form. Side agreements are only valid if recorded in writing. This also applies in particular to assurances of specific properties. If any individual provision is invalid, the validity of the remaining provisions is not affected.

2. Liability / Warranty

The warranty covers only the services provided by JMD. In particular, no liability is assumed that the service can be used for a specific purpose of the client unless expressly agreed. This applies especially to unusual uses.

No warranty is assumed in cases of improper storage or use of JMD products (e.g., UV exposure, scratching, unsuitable chemicals or cleaning agents).

For helmets, JMD assumes no guarantee for the homologation required by the respective racing series. This responsibility lies with the customer.

Chrome coatings are considered a special effect and may show minor irregularities. Matte coatings are only of limited durability, and fluorescent colors lose their luminosity under UV exposure.

Obvious defects must be reported in writing within 4 weeks of delivery.

For products supplied by the customer, JMD assumes no warranty with regard to material defects or surface condition.

3. Payment / Retention of Title

Unless otherwise agreed, payment is due within 10 days. If the delay exceeds 30 days, dunning or collection fees may be charged.

A deposit of €300 is deemed agreed upon placement of the order. For an order volume of €10,000 net or more, an advance payment of 50% may be required.

Graphics that do not lead to an order will be billed based on time spent. The €300 deposit is not automatically sufficient in this case.

Until payment is made in full, the deliverable remains the property of JMD.

4. Design Templates / Copyright

JMD services may not be reused or reproduced without express permission. Drafts and ideas are protected by copyright.

JMD assumes no liability for data provided by the customer. Provided graphics and images may not be published without consent. Only a right of use is transferred, not ownership.

The use of JMD designs by other companies may be pursued legally.

If customer-supplied templates infringe third-party rights, the customer is liable.

5. Shipping / Payments

Shipping is at the client’s risk. Payments are due within 10 days of the invoice date. Delays in delivery do not entitle the client to claims for damages.

6. Place of Jurisdiction

German law applies. The place of jurisdiction is JMD’s registered office.
